General conditions



ARTICLE 1: General
Paragraph 1. General
Name:
Tickets4U BV

Trade:
Chamber of Commerce in Amsterdam (number: 34217084).

Objective:
Mediating in the purchase and sale of admission tickets for events in the broadest sense of the word.

The general conditions of Tickets4U BV have been prepared with the aim of creating clarity between the purchaser and seller, Tickets4U BV, relating to payment and delivery obligations of both parties.

The Dutch margin scheme applies to all prices. This means that no VAT is charged on these prices.

Paragraph 2. Application Conditions
The general conditions apply to all agreements between Tickets4U BV and the purchaser or vendor. The general conditions are applicable regardless of the domicile of the parties involved in the contract and also regardless of the place where the contract has been concluded or is implemented.

Paragraph 3. Acceptance
The placing of an order implies that the applicability of these conditions are accepted. If the purchaser does not agree with the content of the terms of the purchasing party, this must be put in writing, with reasons, within 72 hours to protest against the contents thereof.

ARTICLE 2: The establishment and the content of the agreement
Paragraph 1. The conclusion of the agreement
An agreement between Tickets4U BV and the purchaser, is achieved by means of:

- an online order on the site www.tickets4u.nl
- an email to [email protected]

Dutch law always applies to the agreement between the parties and in the case of the creation of a legal dispute, the judge of the District Court of Zaanstad is authorized to assume interest.

Paragraph 2. Revocation
An offer made by Ticket4U is without obligation and, if necessary, can be revoked by Tickets4U BV but no later than 72 hours after acceptance of the contract. Revocation due to correction of errors in the pricing of Tickets4U BV is permitted.

If the purchaser has not paid the order within seven days Tickets4U BV are authorized to cancel the order, without notice and without giving reasons.

Paragraph 3. Obligations of purchasing party
The purchasing party shall provide Tickets4U BV with all required information at the conclusion of the agreement. If the purchaser is deemed to have fallen short of this, or the data is inaccurate, costs incurred (by Tickets4U) can be recovered and the contract can be terminated.

If the ordered admission tickets are not picked up for the event or if the buyer does not cancel the order online through his/her own login on our website, the made order is still in force and the agreed amount will be charged to the buyer.

If the other party fails to pay on time, there will be a contractual interest rate of 0.5% per month charged to the purchaser.

ARTICLE 3: Payment
Paragraph 1. Prices
The prices are based on cost factors such as any transport, social costs, brokering, taxes, etc. in effect at the time of the offer or the contract between the purchaser and Tickets4U BV. Unforeseen changes in the above cost factors at the time of conclusion of the agreement may lead to price increases.

An established earlier agreement does not apply automatically to repeat orders.

Paragraph 2. Payment
Tickets4U BV offers a number of payment methods that can be utilized. The tickets are shipped or delivered once payment to the account of the Tickets4U BV is credited or cash is paid.

Tickets4U BV is authorized to ask for 20% of the total amount per booking with a deposit of a minimum amount of 10.00 Euro per ticket.

ARTICLE 4: Delivery Methods
After conclusion of the contract the purchaser may choose from the following delivery methods:

Paragraph 1. Registered mail
Costs are Euro 4.50 for shipments within the Netherlands. After payment of the order and the shipping, the order will be shipped via registered mail of TNT Post. TNT delivers within 3 days after the order is processed by Tickets4U BV.
If the TNT Post employee is unable to deliver the order in person,the shipment will be sent, where it can picked up the next working day, to the nearest post office. It will be possible to pick up the order for up to two weeks. You will be informed by means of a written notification from TNT.

Paragraph 2. Registered mail with signature
Costs are 9.50 Euro for shipments within the Netherlands. After payment of the order and the shipping, the order will be shipped by TNT Post with declaration of value and the need for the recipients signature. TNT delivers within 3 days after it is sent by Tickets4U BV.
If the TNT Post employee is unable to deliver the order in person,the shipment will be sent, where it can picked up the next working day, to the nearest post office. It will be possible to pick up the order for up to two weeks. You will be informed by means of a written notification from TNT.

Paragraph 3. Shipping with insurance
Costs are 6.50 Euro for shipments within the Netherlands. After payment of the order and the shipping, the order will be sent, insured, by TNT post. If the TNT Post employee is unable to deliver the order in person,the shipment will be sent, where it can picked up the next working day, at the nearest post office. It will be possible to pick up the order for up to two weeks. You will be informed by means of a written notification from TNT.

Paragraph 4. Shipping without signature
This happens without charge but the risk lies with the buyer. After payment of the order, the order will be sent by ordinary TNT Post. In case of loss, Tickets4U BV is not liable.

Paragraph 5. Courier
Costs are Euro 25.00 for shipments within Netherlands. After payment of the order and the shipping the order will be with you within 3 business days by means of a courier.

Paragraph 6. Pick up at the Tickets4U BV office
The purchasing party can pick up the reserved entrance tickets within one week after the conclusion of the agreement by making an appointment. After this period, the contract can be terminated by Tickets4U BV.
Pick up at the office is possible only if this is specified by the relevant concert/event.

Paragraph 7. E-tickets:
These can be ordered and shipped while supplies last.

What is an E-ticket?
E-ticket (electronic ticket) grants, as well as a traditional paper ticket, the right of access to a concert, theatre, sports or any other similar event. You will receive the e -ticket to print out. This allows you to book your tickets very close to the event/concert. Once your payment has been processed, your E-tickets will be sent to you as soon as possible. You will receive more information on your order from your order confirmation, as there can be differences between different events.To open your e -ticket you only need to have Acrobat Reader from Adobe, version 6.0.1. This software is available free of charge and can be downloaded here. Use plain white A4 paper. Please note, print in high quality. Do not use the economy mode. Also, a Laserjet is recommended inkjet printing can be unreliable. The print must be made with a print size between 93% and 100%. The E-ticket can be printed either in monochrome or color. If your print is not clear, you can print your E-ticket again from the section My T4U. The second print does not differ from the first printout. You also DO NOT get charged twice. The ticket gives you a one-time access and shall be rendered void after it has been scanned at the event. No one ticket can be used twice. If you are still experiencing problems with your E-ticket, please contact our office on 075-6122229 and listen carefully to the menu. Please make sure that there is only one copy of the ticket. As mentioned, the ticket can only be used once by one person. The E-ticket is like a traditional ticket in terms of exchange and refund.

Paragraph 8. Traditional tickets
If the event occurs within two working days after the order is completed, then the tickets can only be collected. The purchasing party can call to make an appointment with Tickets4U BV about the pickup of the entrance tickets.
If the purchaser does not collect these entrance tickets at the agreed time, Tickets4U BV is entitled to cancel the order and sell it on to third parties. If Tickets4U BV fails to sell the tickets to third parties the full cost will still be recovered from the person who placed the order and has not canceled and/or collected it/them, unless otherwise agreed.

Paragraph 9. Pick up location
The purchasing party can pick up the reserved entrance tickets for the event from one of our employees by showing their ID and your order confirmation, after agreement on the time of the appointment.
This may be up to one hour before the start of the event. After this period, the contract can be terminated by Tickets4U BV without notice.
Pick up at the office, without notice, is possible only if this is specified by the relevant concert/event.

Paragraph 10. Cancellation
If the tickets are not collected or paid for and the event is more than 2 weeks away, no further charges will be incurred. Upon cancellation, if the shipping is already paid and the order collected, the tickets can not be returned or canceled.
If you cancel within 2 weeks of the concert/event, there is 25% of the agreed sale price of the product plus the agreed service charge levied on the buyer.
If cancellation takes place one week before the concert/event or within 1 week before the concert/event takes place, there is 50% of the agreed sale price of the product plus the agreed service charge levied on the buyer.
When cancellation occurs within 24 hours prior to the concert/event, there is 75% of the agreed sale price of the product, plus the agreed service levied on the buyer.
Cancellation is possible via the 'My T4U' section on our website.

If the other party fails to pay on time, a rate of interest of 0.5% is levied per month.

ARTICLE 5: Unforeseen circumstances and risks
Paragraph 1. Majeure, unforeseen circumstances and liability
Force majeure is a fault or carelessness of others for which Tickets4U BV can not be held responsible, and which renders Tickets4U BV unable to perform their services.

Paragraph 2. Bankrupcy event organizer
If an event is canceled in connection with the bankruptcy of the organizer or supervisor or the location of the event, then this is force majeure. Tickets4U BV will submit a claim for refund to the appointed trustee and administrator. Once Tickets4U BV is refunded, the money will be returned as soon as possible to its customers. If only a percentage is paid by the receiver, this percentage will be divided among the customers of Tickets4U BV.

Paragraph 3. Change of venue
A change of venue in no way affects the validity of the tickets. Further information will be provided through a service email.

Paragraph 4. Cancellation event
On cancellation of a concert/event 100% of the price of the ticket paid by the purchaser will be returned. This reimbursement may be made by paying back to the bank account, credit or deduction from the purchase of a new ticket.

Paragraph 5. Validity ticket
The purchasing party understands that Tickets4U BV is not an official seller of admission tickets. The purchaser understands that organizers of an event and/or the official providers of the tickets may proceed to block the tickets (or render them void) offered by a retailer. The parties agree that in such a situation Tickets4U BV will try to reclaim the purchase price of the ticket or will substitute that ticket with another if that ticket has been blocked (or declared void) by fault of the purchaser. For example, by sharing information on the ticket with others.

ARTICLE 6: Changes/Additions
The company always has the right to amend and/or supplement the terms and conditions. These changes and/or additions are not retroactive.
